These Terms and Conditions ("Agreement") govern the provision of pet waste removal services ("Services") by Elite Sanitation LLC ("Company," "we," "our," or "us") to the customer ("Client," "you," or "your") in accordance with the following terms. By requesting or accepting our services, you agree to be bound by the terms outlined in this Agreement.

1. Introduction

Elite Sanitation LLC is a pet waste removal company located in Winfield, Kansas. We provide professional pet waste removal services to residential and commercial properties. Our contact information is as follows:

2. Services Provided

Elite Sanitation LLC offers pet waste removal services, including but not limited to:

• Poop scooping from residential and commercial properties

• Pet waste disposal

• Regular scheduled cleaning or one-time visits

• Disposal of waste in accordance with local regulations

• Emergency Cleaning Service: Immediate pet waste removal for urgent situations, including property clean-up after pet accidents or special events.

• Cat Litter Box Change: Cleaning and replacing cat litter in litter boxes, ensuring hygienic and odor-free conditions for your pets.

• Pet Waste Station Installation & Services: Installation of pet waste stations at commercial or residential properties, along with ongoing maintenance and service to keep the station stocked and clean.

Specific services provided will be outlined in the service agreement or package selected by the Client.

3. Client Responsibilities

As a Client, you are responsible for the following:

• Access: You must ensure that the area where pet waste removal is to occur is accessible to our technicians.

• Accurate Information: You must provide accurate and complete information about the location, the number of pets, and any specific instructions related to the service.

• Proper Pet Care: It is your responsibility to ensure that pets are either contained or removed from the area during service visits to allow our technicians to perform their work safely.

• Payment: You must pay for the Services rendered as per the agreed terms.

4. Service Fees and Payment

• Pricing: The price for our Services will be agreed upon between the Client and Elite Sanitation LLC, and will be based on the scope and frequency of the requested services.

• Payment Terms: Payments are due upon receipt of the invoice unless otherwise agreed. We accept payments via credit card, debit card, or other methods as specified by us.

• Late Payments: If payment is not received by the due date, a late fee may be assessed, and services may be temporarily suspended until payment is made.

• Refunds: Refunds for Services will be issued at our discretion, based on the circumstances of the service and client satisfaction.

5. Cancellation and Rescheduling

• Client Cancellations: If you need to cancel or reschedule a service, you must notify us at least 24 hours in advance. Failure to do so may result in a cancellation fee or the full charge for the missed service.

• Company Cancellations: Elite Sanitation LLC reserves the right to cancel or reschedule any service for reasons such as inclement weather, unsafe working conditions, or other unforeseen circumstances. We will attempt to notify the Client as soon as possible.

6. Liability

• Damage to Property: Elite Sanitation LLC is not responsible for any pre-existing damage to property or landscaping unless caused directly by our service. Clients should ensure their property is secure and safe for our technicians to access.

• Indemnification: The Client agrees to indemnify and hold Elite Sanitation LLC harmless from any claims, damages, or liabilities arising from their failure to provide accurate property information or from failure to ensure safe access to their property.

• Limitation of Liability for Data Security

  Elite Sanitation LLC, including its members, employees, and contractors, shall not be held liable for any loss, theft, or unauthorized access to a customer's financial or personal information, whether such information is stored on Elite Sanitation LLC's systems, software, or third-party platforms used in connection with providing services. This includes, but is not limited to, the theft of customer information from our computers, software, or physical records, even if Elite Sanitation LLC does not own or control the software or systems involved.

  Elite Sanitation LLC shall not be responsible for any direct, indirect, incidental, consequential, or other damages arising from such breaches of security, regardless of the severity of the incident. While we make every reasonable effort to protect customer information and maintain privacy, no system or method of data transmission is entirely secure.

  Elite Sanitation LLC is committed to keeping all customer information private and confidential and does not share or disclose such information to any third party without the express consent of the customer, except as required by law.

7. Confidentiality

Elite Sanitation LLC values your privacy. Any personal information collected will be used solely for the purposes of providing our services. We will not share your personal information with third parties without your express consent, except as required by law.

8. Intellectual Property

All materials, trademarks, logos, and other intellectual property related to the services provided by Elite Sanitation LLC are the exclusive property of Elite Sanitation LLC. No Client is granted any right to use any intellectual property related to our services without prior written consent.

9. Termination

Either party may terminate this Agreement at any time, with or without cause, by providing written notice to the other party. Upon termination, the Client will be liable for any outstanding fees for services rendered.

10. Governing Law

This Agreement will be governed by and construed in accordance with the laws of the State of Kansas. Any disputes arising from this Agreement will be resolved in the appropriate court located in Cowley County, Kansas.

11. Force Majeure

Elite Sanitation LLC will not be held liable for any failure or delay in performing services due to causes beyond our reasonable control, including but not limited to acts of nature, accidents, labor disputes, or other events that prevent our ability to perform as expected.

12. Modifications

Elite Sanitation LLC reserves the right to modify these Terms and Conditions at any time. Any changes will be posted on our website or communicated directly to the Client. Continued use of our services after such modifications constitutes acceptance of the new terms.
